Obtaining a Marriage License

Both persons must appear before any town clerk in Massachusetts

To apply for their licenses

Both persons must be eighteen years of age. The couple should bring their birth certificates with them when applying for a license

If one or both are under eighteen years of age, a  court order will be required

It is not necessary for either individual to be a resident of Massachusetts to apply for a marriage.

There is no medical certificate or blood test required for a couple to apply for a license

After the application has been made, then there is a three day waiting period for before the license can be issued. This does not include the day that the application is made.

The three day waiting period may be waived in certain cases of hardship, but this would require a court order of the  probate court, family court or district court.

The couple may be married in any town or city in the Commonwealth, but the Justice Cannot perform the ceremony without the marriage license.

Following the ceremony and marriage, the Justice should provide some proof of marriage. The license may not be copied The Justice will file the marriage license in the place where it was issued by the tenth day of the next month and then it is possible for the couple to obtain certified copies of their license

For any other questions it would be best for the individuals to consult any local town clerk in Massachusetts. The application can be made before any town clerk in Massachusetts
